San Juan Coal Plant Replacement Power Case Continues
The 2nd week of the evidentiary hearing is underway. PNM has admitted that their plans to pursue the gas plant in their "preferred scenario" have been predetermined since 2013 so that they could earn more profits (through large fossil capital investments), and that all of the bids for alternative energy supplies expired as of December 2019 - making alternatives to their preferred plan infeasible.
Join us this Sunday for an update on the case and hear from our Expert Witness Dahr Jamail who will testify about the severity of the climate crisis and in support of our call for a moratorium on new gas plants for our electricity supply.
UPDATE 01/31/2020 - Listen to AUDIO of Dahr Jamail's testimony and cross examination here.
Supreme Court Oral Arguments on Applicability of Energy Transition Act
UPDATE: This Morning [Wednesday, January 29, 2020] the Supreme Court Ruled that the Public Regulation Commission Must Apply the ETA
After hearing oral arguments this morning the Supreme Court ruled from the bench that the PRC must apply the ETA - citing the date of the ETA's passage and the subsequent date of PNM's Abandonment Case Filing.
The Court said they will issue a written opinion soon.
Join us this Sunday 2/2 at 11am @ Collected Works to Reflect and Discuss Next Steps
Join us for a discussion on the Supreme Court decision, what it means for the PRC Abandonment & Replacement Power Cases, as well as an update on Community Solar (committee hearing moved to Saturday - please see below) and other legislative priorities. We are grateful to have the opportunity to put the Court's decision in a broader context and conversation -- How do we work to protect the communities and lands we love and fight to address the urgent climate crisis as regulatory protections are eroded here and across the country? What are our community's defenses and shields against corporate influence and government corruption?
In December the Governor, ETA bill sponsors, and proponents filed an Emergency Petition before the Supreme Court asking the Court to force the PRC to apply the ETA to the pending San Juan Abandonment Case. New Energy Economy and other parties petitioned the Court to intervene. The Court denied our entry into the case but allowed PNM to join as a cross-petitioner. Today the Court denied our Motion to reconsider. We are surprised by the Court's approach to intervenors in the case who, like PNM, are vested parties.
